This Terms and Conditions of Membership (the “Agreement”) is entered into by and between Live Well Membership, LLC, a Florida LLC (the “Company”), and you (the “Member”) on the date Member enrolls in the Membership.

By enrolling in the Live Well Membership, Member agrees to the following terms and conditions.

1. Membership Benefits Upon payment of the Membership fee, the Member shall be entitled to the following benefits:

1. Participation in the Company’s events and programs, including 16 vouchers to our weekly Members-only bonfires.

2. Welcome box.

3. Member cards and discounts on products and services offered by the Company and partners.

4. Our trip planning and concierge team.

5. 14 days of home use in any of our locations. Peak season stays may incur an additional nightly fee.

6. $1,000 in annual Live Well Rewards (Monthly Plan) or $1,250 in annual Live Well Rewards (Annual Plan) will be provided to all members who join after 2/25/2025. Live Well Members who joined prior to 2/25/2025 will receive Live Well Rewards at their next renewal in lieu of seven days of off-season vehicle use. Live Well Rewards can be used on 30A only. Golf carts in Watercolor cannot be paid for using Live Well Rewards. Here’s a list of the services and rentals the Live Well Rewards can be used on and for.

2. Membership Fees The Membership fee is charged monthly or annually, depending upon the terms at the time of registration. The Membership fee is due and payable upon the Member’s acceptance of this Agreement. See our Member plans page for current pricing.

3. Term of Membership The term of this Agreement shall be for one year. The Member may renew their Membership for an additional year by paying the Membership fee. This will happen automatically each year.

4. Credit Card Charges The credit card used to sign up for the Membership will be automatically charged each month or year for the Membership fee and for any additional purchases made to the Member’s Membership account, including but not limited to housekeeping fees, home rentals, bike rentals, beach chair rentals, and transportation. A 3% processing fee will apply to these additional purchases. Family Members listed on the Membership account are also authorized to make charges to the associated Member account.

5. Other Fees By enrolling, Member agrees and authorizes the following charges:

1. Cleaning Fees: 1-5 Bedrooms ranging from $295 to $595 as specified in the Company price list.

2. Housekeeping-only Member stays: Each time a Member uses a Live Well home during the off-season, a housekeeping fee will apply. Should the home be located in Watercolor or Seaside, an additional amenity fee may apply.

3. Car Service: Should a Member choose to have a Jeep, Suburban, or other car waiting at the airport upon arrival or departure, associated fees will apply.

4. Vehicle Rentals: Each vehicle rental includes a $10 per day fuel charge.

6. Guests and Gifting Membership Benefits Members are welcome to bring family and/or guests during off-season weeks, but max capacities still apply based on Membership type. All Membership benefits can be gifted to friends over the age of 27. The Member must connect the guest with the Member Liaison via email, text, etc. Any charges guests make will be billed to the Member’s account unless alternative arrangements are made.

7. Pets Pets (dogs only, under 40 lbs) are only allowed in specified “pet-friendly” homes. A fee applies. Cats are strictly prohibited. Unauthorized pets or damage will result in Membership termination.

8. Housekeeping-Only Stays Member is entitled to 14 nights per year. If Member nights are used for green dates on our calendar the only fee is housekeeping. If Member nights are used during yellow dates there may be an additional nightly fee. View calendar here.  Max occupancy rules apply (e.g., 4 guests for 2BR, 10 guests for 5BR). Unused days do not roll over.

9. Equipment and Vehicle Use Terms If a Member utilizes concierge credit or payment for a vehicle, golf cart, e-bike, bicycle, or other recreational equipment (collectively, “Equipment”), the following terms apply:

1. Insurance: Member must maintain up-to-date insurance that covers rental cars. Member and/or Member’s insurance will cover all liability and repairs for the vehicle and any other vehicle/property involved in an accident.

2. Age Restrictions: No one under the age of 30 may operate the Company’s motorized vehicles (cars/SUVs). Member agrees to adhere to all age restrictions posted for e-bikes and other Equipment.

3. Usage Restrictions: Vehicles/golf carts/ebikes are for 30A use only. No driving on beaches or unpaved roads.

4. Condition: No smoking or pets in vehicles ($250 fine). Member must return Equipment clean and in the same condition received.

5. Minors: Member assumes full responsibility for any minor children using Equipment (see Section 16).

10. Rules of Membership Failure to adhere to rules (including check-in/out times, smoking bans, and guest limits) can result in fines and/or immediate Membership termination. The Company reserves the right to charge $500 per night for housekeeping only stays cancelled within 30 days of arrival and $200 per group for bonfire reservations cancelled after 10am on the day of the fire. It’s not our desire to charge you. In fact, we have never charged a Member a cancelation fee. But we reserve the right to do so to deter Members from making reservations they are not sure they can keep.

11. Consequences for Breaking the Rules The Company may issue a warning, account suspension, or account termination.

12. Membership Cancellation Members must provide 30 days’ notice before their annual renewal date. Monthly plans require a 12-month commitment. Fees are non-refundable.

13. Termination Without Cause Live Well Membership reserves the right to terminate a Membership at any time without cause.

14. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

15. Entire Agreement This Agreement constitutes the entire agreement between the parties and supersedes all prior communications.

16. LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK PLEASE READ CAREFULLY. This section affects your legal rights and the rights of your minor children.

1. Assumption of Risk: Member acknowledges that the use of Equipment (including vehicles, golf carts and e-bikes) involves inherent risks of serious bodily injury, death, and property damage. Member, on behalf of themselves and any minor children or guests, voluntarily assumes all such risks.

2. Release of Liability: To the maximum extent permitted by Florida law, Member hereby releases, waives, and discharges Live Well Membership, LLC, its owners, and employees from any and all claims or liability for injury, death, or damage arising out of the use of Company homes, vehicles, or Equipment, including claims resulting from the ordinary negligence of the Company.

3. Binding Agreement for Minors: Member represents they are the legal parent or guardian of any minor children utilizing Membership benefits or Equipment. Member expressly agrees to bind said minors to this waiver and release.

4. Indemnification: Member agrees to indemnify and hold the Company harmless from any claims, including attorney’s fees, brought by the Member, Member’s guests, or on behalf of any minors, arising out of their stay or use of Equipment.

IN WITNESS WHEREOF, by enrolling in the Live Well Membership and checking the “I Agree” box, Member acknowledges they have read, understood, and agreed to be bound by these terms.
