Terms and Conditions of Membership
This Terms and Conditions of Membership (the “Agreement”) is entered into by and between Live Well Membership, LLC, a Florida LLC (the “Company”), and you (the “Member”) on the date Member enrolls in the Membership.
By enrolling in the Live Well Membership, Member agrees to the following terms and conditions.
1. Membership Benefits
Upon payment of the Membership fee, the Member shall be entitled to the following benefits:
- Access to the Company’s website and online resources.
- Participation in the Company’s events and programs, including 16 vouchers to our weekly Members-only bonfires.
- Welcome box.
- Member cards and discounts on products and services offered by the Company and partners.
- Our trip planning and concierge team.
- 14 days of off-season home use. Additional off-season housekeeping-only stays can be added for a fee.
- $1,000 in annual concierge credit (Monthly Plan) or $1,250 in annual concierge credit (Annual Plan) will be provided to all members who join after 2/25/2025. Live Well Members who joined prior to 2/25/2025 will receive an annual credit at their next renewal in lieu of seven days of off-season vehicle use.
2. Membership Fees
The Membership fee is charged monthly or annually, depending upon the terms at the time of registration. The Membership fee is due and payable upon the Member’s acceptance of this Agreement. Membership fee is dependent upon the date of registration.
3. Term of Membership
The term of this Agreement shall be for one year. The Member may renew their Membership for an additional year by paying the Membership fee. This will happen automatically each year.
4. Credit Card Charges
The credit card used to sign up for the Membership will be automatically charged each month or year for the Membership fee and for any additional purchases made to the Member’s Membership account, including but not limited to housekeeping fees, home rentals, bike rentals, beach chair rentals, and transportation. A 3% processing fee will apply to these additional purchases. Family Members listed on the Membership account are also authorized to make charges to the associated Member account.
5. Other Fees
By enrolling, Member agrees and authorizes the following charges:
- Member bonfires: Additional vouchers (after the 16 per year have been used) are $25 per person per fire. Children under 12 are free.
- Cleaning Fees:
- 1 Bedroom: $295
- 2 Bedrooms: $345
- 3 Bedrooms: $425
- 4 Bedrooms: $450
- 5 Bedrooms: $595
- Housekeeping-only Member stays: Each time a Member uses a Live Well home during the off-season, a housekeeping fee will apply. Should the home be located in Watercolor or Seaside, an additional amenity fee may apply.
- Car Service: Should a Member choose to have a Jeep, Suburban, or other car waiting at the airport upon arrival or departure, associated fees will apply.
- Vehicle Rentals: Each vehicle rental includes a $10 fuel charge.
6. Guests and Gifting Membership Benefits
- Members are welcome to bring family and/or guests during off-season weeks, but max capacities still apply based on Membership type.
- All Membership benefits can be gifted to friends over the age of 27. The Member must connect the guest with the Member Liaison via email, text, etc.
- Any charges guests make will be billed to the Member’s account unless alternative arrangements are made.
7. Pets
- Pets are not allowed in Member homes unless specified on the listing page.
- A pet fee will apply for pet-friendly homes. Only well-behaved dogs under 40 lbs are allowed.
- Cats are not allowed in any Member homes.
- Unauthorized pets may result in reservation termination and eviction. Excessive barking or damage (e.g., urine stains) will result in Membership termination.
8. Housekeeping-Only Stays
- Each Member can use our Member homes for 14 nights per year during the off-season within one year of the Member’s enrollment date.
- This can be one 14-day stay or broken up into multiple stays.
- A housekeeping fee must be paid for each stay.
- Unused days do not roll over beyond the annual renewal date.
- Max Occupants:
- 2 BR home: 4 guests
- 3 BR home: 6 guests
- 4 BR home: 8 guests
- 5 BR home: 10 guests
- If additional guests are needed, email book@livewellmembership.com for approval or to book another home.
9. Concierge Credits & Vehicle Rentals
- The concierge credit can be used in one stay or multiple stays. Unused credits do not roll over beyond the annual renewal date.
- If a Member uses concierge credit for a vehicle rental, the following terms apply:
- Member must have up-to-date insurance that covers rental cars.
- Member and/or Member’s insurance will cover all liability and repairs for the vehicle and any other vehicle involved in an accident.
- No one under the age of 30 may operate the Company’s vehicle.
- Vehicles or golf carts are not to be used on the beach or any unpaved roads.
- Smoking is not allowed in the Company’s vehicles.
- Member is responsible for ensuring the car is protected from rain.
- Member agrees to return the vehicle clean and in the same condition it was received.
- No smoking, no pets, no driving on the beach: $250 fine.
- Vehicles are to be used on 30A only.
10. Rules of Membership
Failure to adhere to these rules can result in fines and/or immediate Membership termination. Key rules include:
- The primary Member must be present at all times throughout a stay.
- Only guests on the rental request form can stay at the property.
- Check-in/out times are typically 4 PM check-in and 10 AM check-out. Early arrivals and late departures will incur additional fees.
- Members are responsible for following property rules, including trash pickup schedules and check-out instructions.
- No smoking or vaping is allowed in or around the property. A $500 fine may apply.
- Canceling a booking within 30 days will result in a $500 per night charge plus housekeeping fees.
11. Consequences for Breaking the Rules
If a Member breaks any Membership rules, the Company may take the following actions:
- Warning
- Account Suspension
- Account Termination
12. Membership Cancellation
- Members must submit a cancellation request no later than their anniversary/renewal date. Membership fees are non-refundable.
- Monthly plans require a 12-month commitment.
- Members must provide 30 days’ notice before their annual renewal date to cancel by emailing info@livewell30amembership.com.
13. Termination Without Cause
Live Well Membership reserves the right to terminate a Membership at any time without cause. The Member acknowledges they have no claim for damages, compensation, or reimbursement.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
15. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior communications.
IN WITNESS WHEREOF, by enrolling in the Live Well Membership, Member agrees to these terms and conditions.
